NJAPA Continues to Engage on Key Regulatory and Legislative Issues

NJAPA keeps track of a wide range of legislative and regulatory proposals which may impact our industry. A few recent examples of our efforts in this regard include:

• Revisions to the NJ Energy Master Plan- working cooperatively with UTCA and an NJAPA member firm who has particular interest in this issue, we developed and submitted comments to the NJ Board of Public Utilities on proposed changes to the 2019 Energy Master Plan. Those comments are included HERE.

• Proposed Regulations on Solid Waste, Hazardous Waste and Recycling (Dirty Dirt)- working cooperatively with NJCMA and Association Counsel K & L Gates, NJAPA also submitted comments to the NJ Department of Environmental Protection on these proposed regulations. These comments focused primarily on restrictions on storage of RAP and are available HERE.


• Proposed Legislation on Solar Financing- NJAPA has been working with other interested parties and members of the legislature to oppose legislation recently introduced which would dramatically reduce the current payments for SRECs to solar facility investors in favor of a fixed payment with the saving being directed back to the ratepayers. This effort would undermine businesses who took a calculated financial risk while relying on a government program established to incentivize those investments in clean energy. Governor Murphy and the BPU are advocating aggressively in favor of this proposal while many and varied interest groups are opposed. The legislation can be accessed HERE.
